Agreement to these terms

These Terms of Service ("Terms") govern your use of the Hillside members' application and related services (the "App"), provided by [ Hillside Country Club Co., Ltd. ] ("Hillside", "we", "us"). By downloading, accessing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Eligibility

The App is provided to current members of Hillside Country Club. To use it you must be a member in good standing (or an authorised user associated with a membership), be at least [ 18 ] years old, and provide accurate registration information. Access to the App is a benefit of membership and may depend on your membership remaining active.

Your account

You are responsible for activity that occurs under your account and for keeping your sign-in secure. Where you sign in using Google or Apple, your use of those services is also subject to their terms. Notify us promptly of any unauthorised use of your account.

Membership and access

The App provides access to membership services such as reservations, check-in, privileges and the pro shop. Your use of the club and its facilities remains governed by the club's rules, by-laws and policies (the "Club Rules"). Where these Terms and the Club Rules differ in respect of club facilities, the Club Rules govern.

Bookings and cancellations

Reservations made through the App are subject to availability and to the club's booking, cancellation and no-show policies. Cancellations must be made within [ the cancellation window ] to avoid any applicable charge. We may amend or cancel a reservation where necessary (for example, for maintenance, weather or operational reasons) and will make reasonable efforts to notify you.

Loyalty points and privileges

Loyalty points, tiers and coupons are privileges offered at the club's discretion. They have no cash value, are non-transferable, and cannot be exchanged for money except where required by law. Points and offers may expire, and we may modify, suspend or withdraw the programme, or adjust balances to correct errors, in accordance with the Club Rules.

Purchases and payments

Purchases made through the App (for example, in the pro shop) are processed by our payment provider, [ OPN / Omise ]. Prices, any member pricing, and applicable taxes are shown at checkout. Refunds, returns and exchanges are handled in accordance with the Club Rules and applicable law. You agree to provide valid payment details and that you are authorised to use them.

Acceptable use

• Use the App only for its intended purpose and in compliance with these Terms, the Club Rules and applicable law.
• Do not attempt to gain unauthorised access to the App, other accounts, or our systems.
• Do not interfere with, disrupt, reverse engineer, or place undue load on the App.
• Do not use the App to infringe the rights of others or for any unlawful, fraudulent or harmful activity.

Intellectual property

The App, including its software, design, text, graphics and the Hillside name and marks, is owned by Hillside or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own membership purposes. All rights not expressly granted are reserved.

Third-party services

The App relies on third-party services (including app stores, sign-in providers, the payment provider, and notification services). Your use of those services is subject to their own terms and privacy practices, and we are not responsible for them.

Notice for Apple App Store users

If you obtained the App from the Apple App Store, the following applies: these Terms are between you and Hillside only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

Disclaimers

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure.

Limitation of liability

To the maximum extent permitted by law, Hillside will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Suspension and termination

We may suspend or terminate your access to the App if you breach these Terms or the Club Rules, if your membership ends, or as needed to protect the App or other members. You may stop using the App at any time and may delete your account from within the App.

Governing law and disputes

These Terms are governed by the laws of [ Thailand ], without regard to conflict-of-laws principles. The courts of [ Bangkok, Thailand ] will have jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings elsewhere. We may update these Terms from time to time; the updated version will be posted here, and your continued use of the App constitutes acceptance.
